When an individual has been stopped by law enforcement and charged with a DUI offense, many people do not realize they are being charge with a crime, and even a first time offender may face potential incarceration.

An individual may not only be charged for a DUI (Driving under the Influence) if they are operating a motor vehicle with a blood alcohol content of .08% (blood to alcohol ratio) or higher, but also if they are found to be under the influence of illegal or prescription drugs, or other substances which may impair ones ability to safely operate a motor vehicle.

When determining if an individual who has been pulled over for suspicion of being under the influence of drugs or alcohol is a process which is subject to the general perception of the law enforcement officer.
